What are Drug Offences?
Within NSW there are various types of Drug offences, these are predominantly seen within the Drug Misuse and Trafficking Act 1985.
The two most common offences that clients are charged with are: Possession of a Prohibited Drug and Supply of a Prohibited Drug.
Possession
Possession of a Prohibited Drug is contained in Section 10 of Drug Misuse and Trafficking Act 1985 and carries with it a Maximum Penalty of 2 years imprisonment.
Supply
Supplying a prohibited Drug is contained in Section 25 of the Drug Misuse and Trafficking Act 1985 and the penalties vary depending on the type and quantity of the drug; it is important to note supplying a prohibited drug is a serious offence and lengthy sentences of full time imprisonment are available to the court.
